Thefundamentalfeatureofacourtthatenablesittodispensejustice
isitsindependence.Thisisafeaturewhichnotonlysetsthejudiciary
apart,butalsodefinesit.Itisjudicialindependence1thatallowsusto
differentiatebetweenjudgesandofficials.Itdeterminesboththerole
ofcourtsandofjudgeswithinthestate.Itisnotmerelyanattributeof
thejudicialoffice;itdeterminesitsessence2.Theguaranteethatajudge
whodeliversasentencewillactuponthelawandtheirownconscience,
withoutcavingtoanyexternalpressures,isinscribedintheessenceof
ajudge'sfunction.
Althoughthisinstitutionissofundamentaltotheexistenceofthestate
andoftheentirelegalorder,sofarnocomplexelaborationofithasbeen
produced.Meanwhile,athoroughdiscussionofthisissue,combining
personalandproceduralelements,isparticularlyusefulandneededin
practice.Scholarsdealingwithcivilprocedurallawhavebroachedthe
topiconlysuperficially,addressingmainlytheissuesaroundimpar-
tialityofthejudges,butnottheirindependence.Particularlyevident
istheabsenceofanydogmaticanalysisoftheinfluenceofjudicialand
administrativesupervisioninthisverycontextonthejurisdictional
functioningofthecourts.Meanwhile,anexcessivelybroadjudicial
oradministrativesupervisionmayinterferewithindependenceofthe
