Thisworkisofanalyticalnature3asregardstheexegesisofemergence,
transformations,analysisanddefinitionofjudicialindependenceas
ascientificconcept.Italsodiscussestheinfluenceofrulesandorganiza-
tionofjudges'workonjudicialindependenceandaddressesexceptions
totheruleofjudicialindependence.Theadmissibleconstitutionalre-
strictionstojudicialindependencehavetheirnormativesourceinju-
dicialsupervision.Besidesthejudicialsupervision,independenceof
judgesmayalsobeaffectedbyadministrativesupervision,towhich
aseparatechapterhasbeendevoted.Oneofthetoughestquestions
isrelatedtowhetheritisatallpossibletoseparatethejudicialsphere
fromtheadministrativeoneandhowtoexercisesupervisionofcourts
withoutinterferingintherulingsphere.Inthepartentailingclassifi-
cationofjudicialindependenceguarantees,themonographhasthe
characterofasyntheticelaboration.Itsinglesouttheinstitutionaland
organizationalindependenceofcourtsaswellaspersonalandfunctional
independenceofajudge.Furtheron,theworkdescribesindetailthe
individualguaranteesofjudicialindependence.
Thepurposeofthepresentworkisnottoprovideapoliticalstudies
analysisofthenormativecontextofjudicialindependence.Thus,itdoes
notofferanymusingsonthetheoryofstateandlaworpoliticalsystems,
nordoesitevaluatetheongoingpoliticalphenomenaorhowtheyaffect
judicialindependence.Thismonographisapoliticalanditsetsasideall
thepoliticalandsystemicchangesoccurringoverthepastonehundred
years,ortheproclaimedtheoriesofstateandlaw.Itsobjective,instead,
istoshowthestrict,constitutivesignificanceoftheguaranteesforthe
veryexistenceofjudicialindependence.
Theanalysiscoversnormativeregulationsofconstitutional,system-
-relatedandproceduralcharacter.Nevertheless,adogmaticanalysisof
theinstitutionofjudicialindependencewouldnotbepossiblewithout
anassessmentoftherighttoindependentcourt,basedoncasuistry.The
