Soitisnotwithoutmeaningthattherighttopersonaldataprotectionis
classifiedbythelawmakerasahumanrightplacedinthesametitleoftheCFR
whereprotectionisgrantedtovaluessuchasprivatelife(article7),thefreedom
ofthought,conscienceandreligion(article9),thefreedomofexpressionand
information(article11),thefreedomofassembly(article12),thefreedomof
artandscience(article13)andtherighttoproperty(article17).Terightto
personaldataprotectionissafeguardedbyarticle8clause1oftheCharterof
FundamentalRightsoftheEuropeanUnion25andarticle16clause1oftheTreaty
ontheFunctioningoftheEuropeanUnion(TFEU).26Ifyouassumethatthe
provisionsoftheCFRandtheTFEUareofblanketnatureandthedetailsof
howpersonaldatashouldbeprotectedareworkedoutparticularlyintheGDPR,
itshouldbeconcludedthattheEUlegislatorshavecompletelyomittedthe
proprietaryaspectofpersonaldataprotection,ignoringthefactthatpersonal
dataisgoodswhich,beingintangibleandbelongingtomoralrights,bynomeans
losetheirproprietaryvalue.Soitisnecessarytoobservethatgivingpermission
toanotherpartybythepersondatarelatesto,inparticulartoanentrepreneur
fortheuseofsuchaperson’sdata,hasanefectcomparabletogiving(donating)
benefitstoathirdparty.Inparticulargivingpermissionfortheuseofpersonal
dataformarketingpurposesmeans,infact,thatsuchdatamaybeplacedonthe
market.Processessuchasdatapseudonymisationandprofilingaresecondaryto
givingpermission,whichlegitimatesbringinganindividual’spersonaldatainto
circulation.
Grantinganindividualnegativerights,inparticulartherighttoobjecttodata
processing(article21oftheGDPR),therighttorectification(article16ofthe
GDPR),therighttoerasure(therighttobeforgotten–article17oftheGDPR)
andtherighttorestrictionofprocessing(article18),shouldbeaccompaniednot
onlybyconfirmingthatsuchanindividualhasalsopositiverights,butalsoby
associatingthescopeofsuchrightsandthewayinwhichtheycanbeexercisedwith
theproprietarynatureofthepersonaldataasalegallyprotectedgood.Although
