AlthoughthedrafermakesitclearthattheNon-PersonalDataRegulationonly
relatestoelectronicdataotherthanpersonalandaccordinglydoesnotafect
theEUlegalframeworkforpersonaldataprotectionasoutlinedintheGDPR,it
shouldbenotedthat,pursuanttoarticle13clause1ofthedraf,thisstipulation
appliesonlytopersonaldatainthenarrowmeaningofthistermdefinedinarticle
4item1oftheGDPR.20
EvenifyouassumethatthesolutionsdefinedinthedrafNon-PersonalData
Regulationwillnotapplytothedatathatcanbeusedtoidentifythepersonitrelates
to,theRegulationwillstillincludedatageneratedbypseudonymisation.Inthe
end,theconclusionreachedinthedrafNon-PersonalDataRegulationdoesnot
completelyexcludetheapplicabilityofitsprovisionswithregardtodatathathas
lostitspersonalnatureandenteredlegaluse.Itisindicatedintheliteraturethat
personaldataisfeaturedbythepossibilityofcombiningit,orassigningittothe
individualitrelatesto.Ifinformationisnolongeridentifiable,youcannotregard
aspersonaldataanymore.Inthiscontext,pseudonymiseddataliessomewhere
betweenanonymousinformationandpersonaldata,forpseudonymiseddata
cannotbeassignedtoaspecificindividualifnoadditionaldetails,whicharestored
separately,areavailable.21
Terighttotheprotectionofpersonaldataisregardedbylegaldoctrineandcase
lawasapersonalrightemanatedfromtherighttoprivacyandservingtheprotection
ofintangiblepropertythatcannotbewaivedordispensedwith.22Consideringthe
