Still,acarefulscrutinyoftheTreatyallowsfornotingtheon-goingmodifi-

cationsintheareaofinternalmarketandpoliciessupportingitsfunctioning,

contributingjointlytothesphereofregulation:

thenewlyformulatedobjectivesfortheEUdonotinclude"protection

ofundisturbedcompetitionontheinternalmarket”.Instead,thereisasti-

pulationof”Protocol27ontheinternalmarketandcompetition”saying

that,"theinternalmarket(definedinart.2oftheTreatyontheEU)com-

prisesasystemensuringundisturbedcompetition”,

–

aseparateprotocolhighlightstheimportanceofservicesprovidedfor

thepublicgood.Thisregulationcomplieswiththecharacterofjudicialde-

cisionsoftheTribunalofJusticewhich,inthatcase,departsfrom"the

dominanceofundisturbedcompetition”.TheTreatyexposestheroleand

competencesofstateswithinthenon-businessservices,i.e.publicservices

(e.g.education,healthcare,etc.),

–

intherealmofenvironmentalpolicytheTreatyincludesclearlyarticulated

regulationsoncounteractingtheglobalclimatechanges,

–

withinenergypolicytheTreatyincludes(onrequestofPoland)asolidarity

clause("inthespiritofsolidarityamongmemberstates...”),aswellas

thefoundationsofcommonpolicyonenergy("ensuringsafetyofenergy

provision...”),

–

theTreatyincludesnew,significantregulationsonextendingtheprotection

ofintellectualproperty,

–

TheReformTreatyclearlyaddressedagroupofstatesassociatedwithin

theEconomicandMonetaryUnion(EMUEurogroups).TheTreatyslightly

modifiedtheconditionsforacountry’stransitionfromderogationtoafull

membershipintheEMU.Themodificationliftstherequirement

ofexamining−everysecondyear−complianceofacandidatewith

theconvergencecriteria,

–

ontheservicesmarket,inparticularwithreferencetotherighttofree

movementofworkersandsocialpolicy(socialsecurityconnectedwith

theexportofbenefits)theTreatyallowsgreaterflexibilityintakingde-

cisions,departingfromtheunanimityprinciple.

Adetailedanalysisallowsinferringthat,withsuchanapproach,

thenotionof"theinternalmarket”,asdefinedintheEUdocuments,issy-

nonymouswith"thecommonmarket”appliedinthetheoryofregionalin-

tegration.However,itdoesnotcomplywiththecategoryof"market”explained

againstthebackgroundofeconomy,managementandmarketing(alsosee
