tioning.TheTreatyitself,itsformalstructure,theshapeandthecontentrequire

extensive,interdisciplinarystudies.Ithasnotbeenourintentiontofacesuch

achallenge,andthispaperfocusesonthebasicissuesstipulatedbythetitle.

BypoweroftheTreaty,from2009(followingtheratification)theEUwillhave

becomeauniforminternationalorganisationandasubjectoftheinternational

law.InitspresentformtheEUhasnothadthestatusofalegalperson,

andtheTreatywillbringarudimentaryreformoftheEUsystem.Bypower

ofregulationsthethree-pillarstructureoftheEUhasbeenabandoned,thepro-

ceduresofproclaimingEuropeanlawhavebeensimplified.TheTreatyofLis-

bonisasourcefortheEUprimarylawthatamendsthetwotreatiescurrently

inforce.Consequently,theterm"EuropeanCommunity”ceasestoexist,andit

isreplacedwith"theEuropeanUnion”.Bythesametoken,theTreatyofRome

(1957)proclaimingtheEuropeanCommunity(followingtheamendments

totreatyrevisionsfromAmsterdam(1999)andNice(2003)changesitsname

toTheTreatyontheFunctioningoftheEuropeanUnion(TFEU).Weshould

highlightthefollowingimplicationsoftheTreatyofLisbonfortheEuropean

economy,business,andtheregulatoryframeworkoftheinternalmarket:

–

clearandunivocaldivisionofcompetencesamongtheEU,itsinstitutions

andmemberstates,

–

providingpreciseproceduresforproclaimingprimary(treaty)EUlaw,

–

bringingordertolegislationandlimitingthenumberofsourcesofderiva-

tivelaw,

–

strengtheningtheroleoftheEuropeanParliamentindecision-making

processbygivingitthesamepositioninmajorissuesasthatenjoyedby

theEuropeanCouncil,

–

grantingthenationalparliamentstherighttocommentonthecompliance

oftheEUlegalactswiththeprincipleofsubsidiarity,

–

limitingtheprincipleofconsensusandenhancingthevotingprocedures

withqualifiedmajorityoption,

–

increasingtheflexibilityofoperationwithintheEUframework.

TheworkonthetreatythatwouldreformfunctioningoftheEU,following

thefiascoofthedraftoftheEUConstitution(2005),wasconductedsimul-

taneouslywithbuildingtheprogrammesandpoliciesofdevelopmentofthe

internalmarket.TheTreatywassignedattheendofthefirstyearoftheEU

financialperspectivethatdefinedthedirectionsoffunctioningandthecom-

petencesoffinancialdecisionsfor2007-2013.Thatissueraisedanextensive

socialdiscussiononthedirectionsoftheEUsystemreform,whichfocusedon

anumberofproblemsofeconomy,businessandtheinternalmarket.Amongthe

argumentsforthereformspecialstresswaslaidontheissuesofpoliticaliden-
