methodsofnegotiations,butratherlhow’theydoso.
Itisoflittlehelptolookattheexistingliteratureonlegalnegotia-
tionsinceitissovast.Itisoftenfilledwithterminologicalchaos,and
laissez-faireismwhichisdifficultforalegalphilosophertoaccept.There
arenodefinitionsorcleartypologiesbasedonacceptableontological
orepistemologicalcriteria.Suchalfreecreation’doesnotcontribute
tothepopularizationoftheartoflegalnegotiation,oftenandun-
fairlyconnectedexclusivelytosomepsychologicaloreristicmeth-
ods.Anytheoreticalproposalpertainingtolegalnegotiationsshould
bejustifiablemethodologically.Eachandeveryoneofthemneeds
anunderlyingontologyandepistemology.Thus,acloserinspection
ofthepossiblejustificationsoflegalnegotiationisrequired.
Ourproposalistoidentifythreedifferentmodelsfornegotia-
tions:theargumentation,thetopic-rhetoricalandtheeconomic.The
modelsemploydifferentcriteriafornegotiation:theargumentation
modelusesthecriterionofrightness,thetopic-rhetoricalthecrite-
rionofefficacy,whiletheeconomicthatofeconomicefficiency.The
decisionastowhichofthemodelsshallbeusedhangstogetherwith
thenatureofthenegotiatedcase,ourinterpretationhabits,aswell
asthedynamicsofthenegotiationprocess.Itisnecessarytostress
oncemorethatwearenottryingtodiscovernewlands.Weonly
reconstructseveralintuitionsdeeplyrootedinthestructureofle-
galthinking.Wearefullyawarethatintheso-calledhardcasesone
isforcedtousedifferentmodelssimultaneously,testingtheproposed
solutionfromallpossibleperspectives.Oneshouldexpectinsuch
casesthatthenegotiatedcompromisemeetstheminimalrequirements
ofrightness,efficacyandeconomicefficiency.
Onecouldandshouldlookatthelawfromtheperspective
ofnegotiation,eventhoughitisdifficulttoacceptforapositivist
scienceofthelaw.Thecontemporarylcontinental’lawyerisany-
thingbutakeennegotiator.Sheprefersproceduralsafetyandthe
judgeasanarbiter.Afraidoftheunforeseeableresults,sheisnot
willingtonegotiate.Nonetheless,inthenearfuture,sheisdestined
tobecomeanegotiator.Withthecurrentdynamicsoftheeconomic
