century.Wefailtoexerciseourfreedomandour

power–wedismisstheproceduresofnegotiationswhenwedonot

wantto,ordonotknowhowtoapplythemwhilst,atthesametime,

wecriticizeanythingnew.

Meanwhile,themajorityoflegalcases,especiallyinthespheres

ofprivateandcompanylaw,mayberesolvedwithoutacourttrial,

bytheprocessofnegotiation,withtheuseoftoolsavailabletous.

Wecansaveourclientsandourselvesalotoftime,stressandmoney.

Andwhenwecan,weshoulddoso;weshouldparticipateinanew

legalculture–thecultureofnegotiation.Still,weshoulddisregard

thecontroversiesconcerningthemeaningofwordsandthevalidity

oftheories,lookingdirectlyattheissuesathand.Letuslearnandlet

usteachotherstheartofnegotiating,theartofarrivingatalegally

andethicallyacceptablecompromise,insteadofengaginginpro-

longeddisputes.

Wearenotover-attachedtothetypologyofnegotiationmodels

presentedbelow.Itisjustifiedbutisfarfrombeingtheonlypossible

option.Ourgoalisrathertopresentacertainspectrumofnegotiation,

asetofnegotiatingtoolsthatareatthelawyers’disposal.Wearewell

awarethatthemodelsindicatedareintertwined;onecansimultane-

ouslyusethemethodscharacteristicofdifferentmodels.Thechoice

oftheutilizedmethodsisalwaysconditionedbythenatureofthe

casenegotiated.Inthefollowingsectionsofthischapterweshallat-

tempttoprovidesomeargumentsbackingthetypologywedevelop;

however,webelievethatotherapproachesarealsodefensible.Our

ambitionislimited:weventuretoshowwhatkindsofmethods–and

withinwhatlimits–canbeusedinlegalnegotiations.Moreover,

wearealsopositivethatthemodelswepresentareactuallyused

inreal-lifecases.Theproblemwetrytopinpointconcernsthelevel
