Theconductedresearchjustifiesfirstdistinguishingtwogeneralmechanisms
fortheexpirationofacontinuousobligation:amechanismwithaprimary(main)
functionandamechanismwithanancillaryfunction.Referencetothebasic(main)
mechanismmakesitpossibletoqualifyacontinuousobligationaccordingtothe
criterionofduration,whileinthecaseofacontinuousobligationresultingfrom
alegalactitisalsopossibletoverifythecontentofthelegalactintermsofre-
spectfortheprincipleoffreedom(theprincipleofthelimiteddurationofanob-
ligationalrelationship).Thereferencetothemechanismofanancillarynature,
ontheotherhand,makesitpossibletotakeintoaccountthespecificityofagiven
(typeof)obligationalrelationshipbeingbindingintermsoftime.Theproposed
distinctionbetweenexpirationmechanismsmayalsoapplytootherobligations
thancontinuousones.
Thisisfollowedbyaproposaltodescribethedurationofcontinuousobliga-
tionsbymeansoftwomethods.Thefirstinvolvestheuseoftheconstructsof
anon-fixedtermandfixedterm,i.e.thedeterminationofapreciseexpiration
mechanismatthetimetheobligationisestablished.Inthepresentmonograph,
thismethodisreferredtoasdirectdeterminationofthedurationofacontinu-
ousobligation.Thesecondmethodconsistsindeterminingthedurationofacon-
tinuousobligationinrelationtothedurationofaspecificsituation,includingthe
durationofanotherlegalrelationshiportheoccurrenceofarandomevent.The
specificationoftheexpirymechanisminthiscasetakesplaceduringtheduration
ofthecontinuousobligation.Thismethodisreferredtointhestudyasindirect
determinationofthedurationofacontinuousobligation.
Thethirdchapteralsodiscussesthedivisionofcontinuousobligationswith
regardtothecriterionofterminabilityandnon-terminability.Theresultsofthe
researchsuggestthatacontinuousobligationconcludedforanon-fixedtermisan
obligationwherethebasic(main)expirationmechanismistermination,whichis,
inprinciple,freeforeachparty.Acontinuousobligationconcludedforafixedterm
is,ontheotherhand,anobligationwherethebasic(main)expirationmechanism
forterminationislinkedtotheoccurrenceofafixedevent,which,inprinciple,is
theexpiryofadeadline.
Thelast,fourthchapterofthemonographaddressestheissueofthetermina-
tionofcontinuousobligations.Moredetaileddiscussionofthisissueisjustified
bythespecialfunctionthattheinstitutionofterminationfulfilsindetermining
thedurationofacontinuousobligation.Thisconcernsinparticularacontinuous
obligationofanon-fixedterm.Inthiscase,alackoftheabilitytoterminatecould
leadtothecreationofaperpetualobligation,whichwouldbeincompatiblewith
theprincipleoffreedom.
Theconsiderationscontainedinthischapterrelate,amongotherthings,to
theclassificationofterminationasalegalact,thepersonentitledtomakeadec-
larationoftermination,theissueofthegroundsfortermination,thedifferentia-
