INTRODUCTION
Theconceptofcontinuousobligation,orasimilarconstruct,isusedinmany
legalsystems.However
,itisrarelythesubjectofgeneralstatutoryregulation,or
ofdoctrinalconsiderationsconductedinasystematicmanner.Thespecificnature
ofobligationswhosestructureinvolvestheelementoftimeiswidelyrecognised,
butasyetnouniformconceptionhasbeendeveloped.
ThemonographcontainsadescriptionofcontinuousobligationinthePolish
civillawsystem.Referencetoviewsexpressedonthebasisofotherlegalsystems
ismadeonlytotheextentnecessaryforachievingtheadoptedresearchobjective,
namely,adescriptionofcontinuousobligationfromatheoreticalperspective.The
choiceofthisresearchmethodisjustified,firstly,bythecurrentstateofdevelop-
mentoftheconstructunderanalysis.Thelackofgeneralregulationsor,atbest,
theirnarrowscope,entailsthatthebasisforreconstructingtheessenceofcon-
tinuousobligationisprimarilyspecificregulations.Theiranalysisrequiresthat
extensiveresearchbeconductedwithinindividuallegalsystems.Secondly,one
oftheachievementsofthePolishlegalsystemwastheintroductionofageneral
regulationconcerningcontinuousobligationasearlyas1933(see,inparticular,
Article272oftheCodeofObligations).Thus,importantissuesconcerningthis
legalconstructweredecidedonalmostninetyyearsago.Thisestablishedabasis
forparticulartypesofcontinuousobligationtoberegulated,throughtheconsid-
erationofmorecommongeneralassumptions.
Duetothelimitedscopeofthispublication,theanalysisandconsiderations
focusonfourfundamentalissues:(1)theessenceofcontinuousobligation;(2)the
possibilityofdistinguishingcertaingeneraltypesormodelsofcontinuousobli-
gation,andthenofidentifyingspecifictypesofcontinuousobligationwithinthe
generalframework;(3)thedurationofcontinuousobligation;and(4)thetermi-
nationofcontinuousobligationasaninstitutionparticularlysuitedtotheexpira-
tionofaobligationalrelationshipofacontinuousnature.
Thefirstchapterisdevotedtoananalysisoftheessenceofcontinuousobli-
gation.Throughoutthemonograph,inaccordancewiththeprevailingposition
adoptedinPolishscholarship,theelementofperformanceisconsideredtobe
