ously,thismustbeofarealcharacter,notjustafaçade,anditis
notinvokedsimplytomasktherealregulationuponwhichthe
decisionisbased.Theapplicationofthelawshouldbeassoci-
atedwiththeimplementationoftheprincipleofequality,mainly
equalitybeforethelaw,and,thus,withtheidenticaltreatmentof
similarsituations.
6.Aparticularlysignificantprincipleoftheruleoflawisthatof
correctlegislation,whichtheConstitutionalTribunalreferredtoin
previousrulingstheastheprincipleofproperlegislation.Setting
asidetheissueofwhichnamecanbeconsideredmoreaccurate,
itmustbeunderscoredthattheprincipleofcorrectlegislation
iscomprisedofafewsignificantrulesregardinglawmaking.Si-
multaneously,itmustbeemphasizedthattheprincipleofcorrect
legislationisinherentlyassociatedwiththeprincipleofcitizens’
trustinthestate,becausecorrectlegislationisnothingmorethan
lawmakingthatrespectstherightsandfreedomsofheindividual
anddoesnotleadtosurprisingcitizenswithnewnormativeacts
thatafiecttheirlegalsituation.Therulesofcorrectlegislationin-
cludethefollowing:theprohibitionofretroactivelaw,thepro-
tectionofacquiredrights,theprotectionofinterestsinprogress,
appropriatevacatiolegis,thespecificityoflegalprovisions,the
ordertoimplementtheprinciplesoflegislativetechnique,orcor-
rectlegislation.
Thebanonretroactivelawisgenerallynotabsolute.Although
itispermissibletodepartfromtheprincipleofnon-retroactiv-
ity,todothisrequiresfulfillingcertainconditions.Aboveall,
theinterestsoftheindividualarekey.Retroactiveactionmust
berelatedtotheabsenceofthedeteriorationofanindividu-
al’ssituation,sothenewlawdoesnotdiminishtheindividual’s
powersorextendtheindividual’sresponsibilities.Atthesame
time,astheConstitutionalTribunalpointsout,itisnecessaryto
addressjustified,specialcircumstancesthatspeakfortheneed
togivesuchprovisionsanearlierdateofentryintoforce,while,
simultaneously,anotherconstitutionalprinciplejustifiesretro-
