Therationalisationoftheparliamentarysystemisalsomanifestedin
appointingtheCouncilofMinisters(Art.154-155oftheConstitution).It
consistsofthreeprocedures:oneprimaryandtworeserveones.Theinitiative
toappointanewgovernmentbelongsalternatelytothePresidentandthe
Sejm.Additionally,inthecaseofthesecondreserveprocedure,thethreshold
forgrantingavoteofconfidencewasloweredfromanabsolutemajoritytoa
simplemajority,makingitpossibletoappointaminoritygovernment.Failure
toappointtheCouncilofMinistersinthisproceduremeanstheobligatory
shorteningoftheSejm’stermofofficebythePresident(Art.155para.2)27.
ThestrengtheningofthePrimeMinister’spositioninthesystemof
stateauthoritybodiesshouldalsobeconsideredamanifestationof
rationalisingtheparliamentarysystem.Heisnotonlyufirstamongequals”
(primusinterpares)butthetrueheadofgovernment28.ItisthePrimeMinister
whopresentsthecandidatesforministerstothePresident,requeststheSejm
tograntthegovernmentavoteofconfidenceandasksthePresidenttomake
changestothecompositionofhiscabinet29.Finally,thePrimeMinisterdecides
toresignhiscabinetnotonlyintheeventofnecessityprovidedforbythe
Constitution(expiryoftheSejm’stermofoffice,failuretograntavoteof
confidence,voteofnoconfidence)butalsobecauseofhisownresignation,
whichhedoesnothavetoconsultwithothergovernmentmembers(Art.162).
Hemaynotbetheaddresseeofanindividualmotionofnoconfidence(Art.
159).TheSejmmayonlybringaboutthePrimeMinister’sresignationby
passingaconstructivevoteofnoconfidenceintheentirecabinet30.
Therationalisationoftheparliamentarysystemisbasedonthe
assumptionthattheSejmhasapermanentmajority.Ifthereisnosuch
majority,theimportanceofotherbodiesofstatepowerincreases.Inparticular,
itshouldbeemphasisedthatinthelegislativeprocedure,theSejmrejectsthe
