Itisdimculttodrawupaclearmethodologicalclassificationof
thesociologyoflawwithinthesystematicparadigmofthesocial
sciences.Ononehand,thisisbecauseitssubject(law)bringsit
closetowhatisbroadlyunderstoodasjurisprudenceinspecie;
ontheother,however,itsresearchmethods(sociologicalmeth-
ods)placeitwithinsociologyingenere.Toputitinasimplified
fashion,onecansaythatwithinthedefinitionofsociologyoflaw,
sociologyisthegenusproximum;however,thedifierentiaspe-
cificaislaw.Fortheseveryreasons,thesituationisbasicallythe
sameaswiththephilosophyoflaw:forsome,itispartoflegal
studies;forothers,itisphilosophy.Themethodologicaldilemma
isnotsolvedbytheformalcriterionoftheinstitutionallocation
ofdepartmentsofphilosophyandsociologyoflaw.Withinuni-
versities,thesearemostfrequentlysituatedwithinfacultiesof
law.However,atthesametime,thereisnolackamongHpure”
philosophersandsociologistsofscholarswhoareconcerned
withthephilosophicalandsociologicalaspectsofthelaw.The
situationofsociologyoflawbetweenlegalstudiesandsociol-
ogymay,however,entailcertainsubstantiveconsequences.In
termsofitsunclearmethodologicalstatus,thesociologyoflaw
issimilartothephilosophyoflaw.Withreferencetothelatter,itis
recognizedthatitmaybepracticedintwoways-Hfromphiloso-
phytolaw”andHfromlawtophilosophy.”But,atthesametime,
thephilosophyoflawpracticedbylawyersisfundamentallydif-
ferentfromthephilosophyoflawthatispracticedbyphiloso-
phers.Thequestionariseswhetherthisistrueofthesociology
oflawtoo.Inotherwords,doesthesociologyoflawpracticedby
lawyersdińerinanyfundamentalwayfromthesociologyoflaw
practicedbysociologists?
