oftheGermanicstatesandinthelawoftheFranks,thecircleofindividualsbetween
whomthesexualintercoursewasregardedasincestuouswasextendedunderthe
influenceoftheCanonlaw.TheregulationsoftheRomanlawandtheCanonlaw
mergedandshapedthecontentofthelaterlawoftheReich.Penalizationofincest
inConstitutioCriminalisCarolinawasnotclearasthedoctrineoflawwasunderthe
influenceofthegeneralRomanlaw(iuscommune)andtheopinionsofauthorities
werequotedintheprocessoflawinterpretation(Carpzov).Adiversifiedevaluation
ofincestwaspresentedinConstitutioCriminalisTheresianawithanextensivelist
ofcircumstancesaggravatingandmitigatingcriminalresponsibility.
