AlthoughnospecialattentionispaidtotheelderlyintheLawontheProtection
ofPersonswithMentalDisabilities,provisionsprescribingabanonresearchon
personswhocannotthemselvesagreetoit,directlyprotecttherightofautonomy
oftheelderlyandprotectthemagainstpotentialabuse.46

Attheregionallevel,significantprogresshasbeenmadeinNorthandSouth
AmericabytheadoptionoftheInter-AmericanConventionfortheProtection
oftheHumanRightsoftheElderly(hereinafer:Inter-AmericanConvention)
on15June2015,whichenteredintoforceon11January2017.47Itspecifically
regulatestheprotectionofthehumanrightsoftheelderly,explicitlyrecognis-
ingtheirrighttoequalityandnon-discriminationongroundsofage(Article5),
therighttolifeanddignityinolderage(Article6),therighttoindependence
andautonomy(Article7),therighttoparticipateandintegrateintosociallife
(Article8),therighttosecurityandalifefreefromanyformofviolence(Arti-
cle9),therightnottobesubjectedtotortureoranyothercruel,inhumanor
degradingtreatmentprocedure(Article10).Tedefinitionofanelderlyperson
isgiveninArticle2andappliestoanelderlypersonaged60orover,unless
thelegislation(oftheStatesParties)prescribesanotherage,provideditisnot
above65years.48
Article11regulatesinparticulartherighttofreeandinformedconsent
inhealthmatters.Furthermore,itregulatestherighttoreceivelong-termcare
(Article12),therighttopersonalliberty(Article13),therighttolibertyofthought
andexpressionandaccesstoinformation(Article14),therighttocitizenship
andfreedomofmovements(Article15),therighttoprivacyandintimacy(Arti-
cle16),therighttosocialwelfare(Article17)and,veryimportantly,primarily
becauseoftheperceptionoftheelderlywithuretirement”,therighttowork(Arti-
